Terms of Service

Effective date: February 11, 2026

These Terms of Service ("Terms") govern your use of the memex.email service ("Service"), operated by Memex ("we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

Memex provides email tag creation, message forwarding, and archival services. The Service allows you to:

  • Create email tags by sending a message to an address under the memex.email domain or a connected custom domain
  • Add members to tags and configure forwarding behavior (immediate delivery, daily digest, or archive-only)
  • Access a searchable web archive of messages sent to your tags
  • Manage namespaces, membership, retention policies, and other tag settings through a web interface

The Service processes and stores email messages on your behalf. By sending email to a Memex address, you acknowledge that the message will be stored, indexed, and delivered according to the tag's configuration.

2. Your Account and Responsibilities

When you create a tag, your email address becomes the owner identity for that tag. You are responsible for:

  • All activity that occurs under tags you own or manage
  • Ensuring that your use of the Service complies with these Terms and applicable law
  • Managing membership and access to your tags appropriately
  • The content of messages you send through or to the Service

3. Acceptable Use

You must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. In summary, you may not use the Service to:

  • Send spam or bulk unsolicited email
  • Distribute malware, phishing attempts, or other malicious content
  • Impersonate another person or entity
  • Transmit illegal content or facilitate illegal activity
  • Abuse the Service's infrastructure or circumvent rate limits
  • Harvest email addresses or personal information from the Service

4. Intellectual Property

You retain ownership of all content you send through the Service. By using Memex, you grant us a limited license to store, process, forward, and display your content as necessary to operate the Service. We do not claim ownership of your messages or data.

The Memex name, logo, and service design are our property. You may not use our branding without prior written permission.

5. Account Termination

You may stop using the Service at any time. You may delete your tags and request deletion of your data by contacting us.

We reserve the right to suspend or terminate your access to the Service if:

  • You violate these Terms or the Acceptable Use Policy
  • Your use of the Service poses a security risk or could harm other users
  • We are required to do so by law
  • Your account has been inactive for an extended period (we will provide advance notice)

Where possible, we will provide notice before suspension or termination and give you an opportunity to export your data. In cases of serious abuse, we may act immediately without notice.

6. Service Availability

We provide the Service on a best-effort basis. The Service runs on Cloudflare's global infrastructure, and we aim for high availability, but we do not guarantee uninterrupted access. Specifically:

  • The Service may be temporarily unavailable due to maintenance, updates, or infrastructure issues
  • Email delivery depends on third-party systems (DNS, receiving mail servers, outbound relays) that are outside our control
  • We may modify, suspend, or discontinue features of the Service with reasonable notice

We do not provide service level agreements (SLAs) for the free tier. If we introduce paid plans, those may include availability commitments.

7. Privacy

Our collection and use of personal data is described in our Privacy Policy. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory
  • We disclaim all warranties including, but not limited to, merchantability, fitness for a particular purpose, and non-infringement
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater

This limitation applies regardless of the legal theory on which the claim is based, even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the effective date at the top of this page
  • Notify active users by email at least 30 days before the changes take effect
  • Post a summary of what changed

Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the changes. If you disagree with the updated Terms, you may stop using the Service and request deletion of your data.

11. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Memex is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable rules, or to the courts of competent jurisdiction.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws in your jurisdiction that cannot be waived by contract.

12. General Provisions

  • Entire Agreement. These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Memex regarding the Service.
  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in effect.
  • Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  • Assignment. You may not assign your rights under these Terms without our written consent. We may assign our rights to a successor entity in the event of a merger, acquisition, or sale of assets.
